Taking strong note of the repeated failures of the Tihar Jail authorities to honour the directions of the court,a Srinagar court has directed the Superintendent of Police,Tihar Jail,to produce Tariq Dar,an accused in the Diwali triple blasts in Delhi before the Principal District and Sessions Judge,Srinagar.

Dar’s lawyers claimed that various reminders had been sent to the Tihar Jail Superintendent of Police,but he has not been produced in the court in the last three years.

Dar,an accused in the 2005 Diwali triple blasts in Delhi,is also facing trial in a case registered in Srinagar. Before his arrest by the Delhi Police in November 2005,Dar used to work as senior sales executive in Johnson and Johnson.

He is also facing trial in a case in the Mahrajgunj police station in Srinagar City under Section 7/25 of the Indian Arms Act. The case was registered before the Delhi blasts.

The trial in the said case has been on in the Srinagar Court for the last three years but during this period,Dar,presently lodged in Tihar,was never produced by the Delhi Police before the Srinagar court.

“Tariq Dar is required to appear personally in court. The trial is getting delayed,” Dar’s lawyers Mir Shafqat Hussain and Mir Urfi,who have been representing his case in Srinagar,pleaded before the court.

Taking strong cognizance of the repeated failure of the Tihar Jail authorities,Principal District and Sessions Judge,Srinagar,Hasnain Masoodi,who has been hearing the case,has now issued a production warrant to them.

“Whereas,the attendance of Tariq Ahmad Dar,at present confined in Tihar Jail,New Delhi,is required in this court to answer to a charge of offences under sections 7/25 of I.A. Act. You,( Jail SP,Tihar Jail No 3) are hereby required to produce the said Tariq Ahmad Dar under safe and secure conduct before the court on 4.11.2009 by 10 am,therefore to answer to the above-mentioned charge or for purpose of the said proceeding,” the court order said.

The Principal District and Sessions Judge further directed the Tihar Jail authorities to inform Tariq Dar of the contents of the court order.
